What you may send, what you may not, and when we will stop sending on your behalf.

These terms govern use of xcelit Outreach and add to the general xcelit Terms of Service. Where the two conflict on a question of sending, these terms prevail. Data-protection responsibilities are set out in the Data Processing Agreement.
One point matters more than any other here: you are the sender. Messages go out from a domain you own and control, over DNS records you publish. We build and deliver them on your instruction; the reputation, and the responsibility, are yours.
You may only send to people whose details you obtained lawfully. You must not upload:
xcelit Outreach is built for business-to-business outreach where a legitimate-interest basis is available. It is not a consumer marketing tool.

Poor sending harms the recipient, your domain, and the shared infrastructure everyone relies on. The product therefore enforces limits automatically rather than after the fact:
We may suspend sending immediately and without notice where we reasonably believe these terms have been breached, or where continuing would endanger the deliverability of other customers. We will tell you why, and restore service once the cause is resolved.
We provide the sending infrastructure, list verification, message generation and reporting. Message content is generated with automated assistance and you are responsible for reviewing it before it is sent; the product provides an approval step for that purpose.
We do not guarantee any reply rate, open rate, deliverability outcome, inbox placement, or business result. Mailbox providers decide independently where a message lands, and we cannot control that. Volume commitments in a plan describe capacity made available to you, not outcomes achieved.
You are responsible for the DNS records you publish to authorise us to send, for keeping them in place while you use the service, and for the security of your account credentials. Removing authorisation records will stop delivery. Tell us promptly at support@xcelit.co.in if you believe your account has been accessed without authorisation.
Plans include a monthly volume of verified prospects and sends. Enrichment and verification draw on paid third-party sources, so these limits are real rather than nominal. Once your monthly quota is reached, sending pauses until the next billing period or until you upgrade. Quotas do not roll over.
Either party may terminate as set out in the general Terms of Service. On termination we stop sending immediately; export and deletion follow clause 11 of the Data Processing Agreement. Refunds are governed by the Refund Policy. Suspension for breach of clause 2, 3 or 4 does not entitle you to a refund.
You will indemnify xcelit against claims, losses and regulatory penalties arising from your breach of clauses 2 or 3 — in particular claims that a message you instructed us to send was unlawful, or that a list you supplied was unlawfully obtained.
We may update these terms. Material changes will be notified to the email address on your account at least 30 days before they take effect, and continuing to send after that date means you accept them.
